For or against software patents in the EU

As if it was necessary to find more arguments against the recently by the EU council adopted proposal for a EU directive that would further enable software patents to be issued within the EU, one of the always more persuasive agruments is that fact that the Economist is opposing the proposal (Login required).

    The Economist writes: “[…] Clearly there may be cases where a better digital mousetrap is worthy of a patent. But if software patents are too easy to obtain, they may stifle innovation more than promote it. Europe needs tougher standards governing their approval […].”

    This seems to be more a question of quality control with regard to the substantial patent examination work of the Patent Offices rather than a question of material criteria of patentability of computer-implemented inventions.
